My dog bit someone but they were warned to stay away?

  • i was waiting for a friend with my dog so i went closer to the parkd cars/curb so he wouldnt bother the people walking past on the footpath but a lady came up to while i was feeding him treats so i said he might bite and that she shouldnt touch him because obviously he was eating food and would be possesive etc but she reachd out and patted him on the head. my dog bit her on the arm and it wasnt a serious injury even though it bled (because he punctured the skin) but it really wasnt entirely his or my fault. the person hu got bitten is reporting this to the city council and i dont know if my dog has a chance or not. none of the animal control laws i have googled helps. this is in new zealand. please help


  • Do you have a witness? If not, this will be a her word against yours. At most, you'll be paying for any injuries she has. Your dog will get to stay alive.

    And was your dog on a leash or chain? If not, then you will be found negligent for sure.


  • i blame her. she should have listened to you and not stroked your dog. if i asked someone if i could stroke their dog, and they said it might bite you, i wouldnt do it

  • l am speaking about Australian law and it seems New Zealand will be the same.You are responsible for your dog entirely and liable if the dog bites someome unfortunately.The only defence you have is that you asked the stranger not to touch and she did without your permission.Food agression is not uncommon and you should train your dog out of this bad habit and it is not really that hard but you may need assistance via an animal behaviourist.Ring your local council or ranger and ask what are the Council laws regarding dogs on and off leads and it will be all set out for you.You have a valid defence and that is the dog was on a lead firstly and was not out of control;secondly you wanrned the stranger to stay away and they contributed to the dog attacking her so she is negligent in this matter.Do not be afraid about contacting your local Council you do not have to tell them the story but find out all the relevant dog laws for your area.l doubt very much if this woman will report you l suspect this is a mere threat to frighten you.Another point were there any witnesses to this incident?If so you have a a much stronger case than she.If a dog is not on a leash and attacks someone you will be liable for a hefty fine and sometimes the dog is put down.As a legal eagle l have had a few of these cases and can assure you that you obviously had full control of your dog BUT in saying that learn to stop this agression as if the dog bites a child you may be held responsible.

  • I don't know the laws in New Zealand but here in the US he might be required to wear a muzzle when he's in public. It sounds to me like you should have him wear a muzzle anyway. A dog that bites for the reason you mentioned, shouldn't be out among people without a muzzle anyway. For your own personal (and financial) protection, I would buy a muzzle ASAP. You don't want to be sued. If he bite a child, it would be in the face since they're smaller.

  • I don't know the laws where you live. But if the dog was on a leash and the woman was warned and the dog is caught up on shots, you should be ok. Stupid people huh?

    YOU are responsible for TRAINING the animal *&* ensuring that it is NOT allowed to cause harm to people or property!

  • Even though the person when against your request and therefore was at fault. By most laws, you will be legally liable. If you have a dog that is prone to biting at all it is your responsibility to protect the public from him. Either with a muzzle or keeping him at home.

  • I live in the US and my dog bit a man. It was a slightly different situation though. I was visiting friends and our dogs had been playing together for hours with no problem.
    My dog was barking at a ball in the yard and their dog ran off the porch and attacked her. We both got their of collars, but the man put his hand in between to break his dog's hold on my dog and my dog bit him. He admitted he was at fault to everyone, he didn't want my dog punished for his actions. But my dog was still put on house arrest for 10 days, She has always had her rabies vaccination on time and see's a vet regularly.


  • if you warned her not to touch him it is entirely her fault. They might try to take him from you, but i would fight it to the end. You might need to get a lawyer ...if they do try to quarantine your dog.

  • If you knew that your dog might bite someone, then you should have a muzzle on him.


  • you told her to stay away so therefore it was her fault. you should be ok if this has never happened before. if it has happened then i don't know. there are so many things that could happen in a case like this. do you have any witnesses that you told hr to stay away? if so then bring them with you.


  • In some countries, the moment they receive a report, the dog is done for. In others, the police or animal control will listen to your side of the story and will think about it. But if your dog was on a leash, I wouldn't see any problems.

    Also, did this person who reported you know you personally, know where you live and all? If not, then you might want to change places to walk your dog for some time so nothing happens.

    I wish you good luck and pray that nothing happens to your dog. Hoenstly, some people are just pig headed, and to blame a dog for that person's lack of intelligent, it really sucks.
