How does an individual person stake a mineral claim in the Province of
Qu bec? Are there documents/ instructions available in English? How do
you check if there is a prior claim? What is the precise staking
process and cost? How much time does it take to get confirmation that
the claim is yours?
I apologize for asking 5 questions instead of one but it just seems to
make sense to group them.
Thank you.

Just what I was looking for. I appreciate the speedy response. Thanks.
Dear uzzz,
The procedures connected with acquiring mining claims in the Province
of Qu bec are described in an online publication [1] issued by the
Department of Natural Resources and Wildlife. For quick reference, I
have extracted basic answers to your questions:
I. How does an individual person stake a mineral claim in the Province of
Qu bec?
Qu bec law allows two ways of acquiring a claim: By map designation,
which is the principal method; and by staking.
To acquire a claim by map designation, follow these instructions:
http://www.mrn.gouv.qc.ca/english/publications/online/mines/claim/claimdesignated_notice.asp
To acquire a claim by staking, follow these instructions:
http://www.mrn.gouv.qc.ca/english/publications/online/mines/claim/claimstaked_lands.asp
II. Are there documents/ instructions available in English?
Yes, the relevant instructions have been made available in English.
You can find them here:
http://www.mrn.gouv.qc.ca/english/publications/online/mines/claim/index.asp
For acquiring a claim by staking, you will principally need the
following two documents (PDF files):
- Prospecting Licence Application
http://www.mrn.gouv.qc.ca/english/publications/mines/rights/2005-2006/permis_prospection.pdf
- Notice of Staking
http://www.mrn.gouv.qc.ca/english/publications/mines/rights/2005-2006/jalonnement.pdf
III. How do you check if there is a prior claim?
To find out whether a particular location has already been claimed by
another party, refer to the competent authorities, depending on
whether you are going to acquire a claim by map destination or by
staking.
The latest locations and boundaries of currently unclaimed designated
claims are displayed on maps accessible at:
- The Office of the Registrar
5700, 4e Avenue Ouest, C 408
Charlesbourg (Qu bec) G1H 6R1
Fax: (418) 643-9297
- The Department's regional bureaus
http://www.mrn.gouv.qc.ca/english/publications/online/include/pourplusderenseignements.jsp
- The website of the Department of Natural Resources and Wildlife
(only in French; available from 25 January)
http://gestim.mrnfp.gouv.qc.ca/ftp//cartes/carte_quebec.asp
If you are planning to stake a claim, you can find out whether a claim
to a particular area of land is already existing by referring to:
- The Office of the Registrar
5700, 4e Avenue Ouest, C 408
Charlesbourg (Qu bec) G1H 6R1
Fax: (418) 643-9297
- The Department's regional bureaus
http://www.mrn.gouv.qc.ca/english/publications/online/include/pourplusderenseignements.jsp
IV. What is the precise staking process and cost?
If you are going to acquire a claim by staking, the necessary
procedures are described in detail here:
Prospecting License and Tags
http://www.mrn.gouv.qc.ca/english/publications/online/mines/claim/claimstaked.asp
Rules for Staking
http://www.mrn.gouv.qc.ca/english/publications/online/mines/claim/claimstaked_rules.asp
Notice of Staking
http://www.mrn.gouv.qc.ca/english/publications/online/mines/claim/claimstaked_notice.asp
As for the cost:
- To legally stake a claim, a person needs a valid prospecting
license. The fee for obtaining this license is 30.00 Canadian Dollars.
This is the application form (PDF file):
http://www.mrn.gouv.qc.ca/english/publications/mines/rights/2005-2006/permis_prospection.pdf
- When staking a claim, metal tags issued by the Department of Natural
Resources and Wildlife must be place at the pickets. A set of four
such tags costs 4.00 Canadian Dollars, available at the Department's
regional bureaus.
- For each staked claim, a registration fee of 24.00 Canadian Dollars
becomes due, to be submitted along with the notice of staking.
V. How much time does it take to get confirmation that the claim is yours?
Unfortunately, the Department of Natural Resources and Wildlife does
not provide any information on this particular point.
Hope this will be useful!
Best regards,
Scriptor
