I have heard of this but what if the person just recently found a job and wants to pay current support and work on paying thousands of dollars in arrears? He has a court date that doesn't state the reason (minutes and order are checked with the court date and time written) and he is really worried about jail and losing his current job. What if he made some kind of payment as soon as possible? Perhaps, maybe he does deserve jail but will the judge do this if he has a job since it would prevent him from paying other parent??
Yes someone will go to jail for non-payment of child support UNLESS they can prove that they just started a job. but he should be reporting that to the child support office...
The most likely result is wage garnishment, where the court will take a significant chunk of his wages for child support before he gets a chance to touch it. MONROE COUNTY Friend of the Court Handbook August 2000 _:: put in the form of a court order, signed by the judge. and entered with the court clerk. may require a payment toward child support or. commit the payer to jail. http://www.co.monroe.mi.us/Monroe/uploadedFiles/HANDBOOK.pdfHOME |
He won't make a payment "as soon as possible", he'll make a payment out of his first paycheck, and it's not what he can afford, it's what the court decides.
All punishments are handed down within the ambit of prevailing laws.
The answer is, yes, if the law so prescribes. It remains up to the consideration of the judge though, as severity, damages, pain, etc, is considered when handing down penalties.
A judge, (black robe devil) will put anyone in jail for any reason if there is more revenue generated in doing so and they can get away with it. There is mega dollars in the prison system. Why do you suppose that we have more people in jails then any other country in the world? It's called the justus system and believe me, there isn't one court system that isn't on the take. They wouldn't be able to operate if they weren't the way the process is structured. Just follow the money trail. When you go to court be ready because it is a whole new world based in the Twilight Zone and not even close to what most people think it may be. You better get yourself an Orwellian dictionary. i doubt it
if he dosent pay
but if he works
money is automatically
taken from his paycheck
before he can cash it
Believe it or not the court will work with you or whoever. Responsibility needs to taken by making immediate contact with the child support agency or family court whoever is handling the case. If family court is handling your case you need to go there and speak to one of those free advice attorneys they will help you out with the proper legal procedures. I f the child support agency is handling it, then they need to be contact it. The situation of the that person will most likely be consider, but it needs to be taken care of right away. Before privileges get taken away, like suspension of a drivers license and possibly jail time.
Good luck!
My mom put my brother's dad in jain for not paying child support several times (even on Father's Day).
What was he doing for money before he got this current job? He needed money for food and shelter. Making partial payments at least shows an effort was put forth. He should bring pay stubs to the hearing along with a proposed repayment plan. The paystubs can also be used in evaluating how much child support he can afford if the current amount is too high.
